These Terms of Use (the "Terms") apply when you visit oahe.ai (the "Site"), which is operated by Oahe Data LLC, a South Dakota limited liability company ("Oahe Data," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy at /privacy.
1. What the Site is
The Site describes our work and invites you to start a conversation with us. The products and services we provide are delivered under our separate written agreements with our clients, not under these Terms.
2. Our products and services
Descriptions of products and services on the Site, including the Sovereign Datacenter Package, are general information. They are not an offer, a quote, or a commitment, and they may change. Every product or service we provide is governed by a written agreement between the client and Oahe Data. If that agreement conflicts with these Terms, the agreement controls.
3. Information on the Site
We work to keep the Site accurate and current, but it is provided for general information only. Examples, figures, screenshots, and illustrations show what our work looks like; some are labeled as examples and are not findings about any place or community. Do not rely on the Site as legal, medical, financial, or engineering advice.
Some material on the Site draws on public data sources, which belong to their original publishers and remain subject to their own terms.
4. Ownership
The Site and its content, including the text, design, illustrations, and the Oahe Data name and logo, belong to Oahe Data or its licensors and are protected by intellectual property laws. You may view the Site and share links to it. You may not copy, republish, or reuse its content for commercial purposes without our written permission. Material shown with the permission of others remains theirs.
5. Acceptable use
You agree not to:
- use the Site in violation of any law or the rights of others;
- attempt to gain unauthorized access to the Site or our systems, or test their security without our written permission; or
- interfere with or disrupt the Site, including through excessive automated requests.
6. Links
The Site may link to other websites, such as public data sources. We do not control them and are not responsible for their content or practices.
7. Tribal sovereignty
Oahe Data recognizes and respects the sovereignty of Tribal Nations. Nothing in these Terms is intended to waive, limit, or abrogate the sovereign immunity, jurisdiction, or governmental powers of any Tribal Nation or tribal entity, or any right or protection under federal or tribal law.
8. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, OAHE DATA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, OR ERROR-FREE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OAHE DATA AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Governing law
These Terms are governed by the laws of the State of South Dakota and applicable federal law, subject to Section 7.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the date at the top of this page.
